Indefinite Leave to Remain is the final visa anyone can get. Anyone with Indefinite Leave To Remain is regarded as someone with settled status. WHO CAN APPLY FOR INDEFINITE LEAVE  ?

There are different routes that applicants can use to qualify for Indefinite Leave to Remain, and they are:

  • Completing five years on a Spouse or Unmarried Partners Visa.
  • Completing five years on an Ancestry Visa.
  • Being in employment for five years in a combination of both Tiers 1 and 2.
  • Subject to investment amount, completing five years on investors visa.
  • Completing five years on a Tier 1 entrepreneur visa.
  • Ten years of legal residence in the UK made up of any visa.

WHAT ARE THE BASIC REQUIREMENTS TO APPLY FOR PERMANENT RESIDENCE (ILR) ?

  • You must pass the life in the UK test to show that you understand the history, traditions and culture of the United kingdom.
  • You have been living in the UK lawfully for a while.
  • You have not breached any immigration rules or have a criminal record during your stay in the UK.
  • You have not spent over 180 days outside the UK in any 12 months during your qualifying period.
  • You must prove that you have the required English language speaking and understanding skill of at least B1 level.

CAN I BE EXEMPTED FROM ENGLISH LANGUAGE REQUIREMENT ?

There are a particular group of people that do not need to fulfil the English language requirement, and they are:

  • Certain majority English-speaking countries including Australia, Bahamas, Jamaica, USA, Canada, New Zealand, St Lucia, Barbados, Ireland, Grenada, St Vincent, Trinidad & Tobago
  • Those over 65 years old
  • Those with degrees taught in English from accredited institutions
  • People who are victims of domestic abuse
  • Those under humanitarian protection
  • A bereaved spouse of a British citizen or a person with settled status

LIFE IN THE UK TEST EXPLAINED

Life in the UK test is a 45 minutes test based on the history, culture and tradition of Britain. It costs £50 to register for the test. The test comprises 24 questions, and the pass mark is 75%.
Those who are 18 or under or 65 years old and above are not required to take the test. Also, those with confirmed medical conditions can be exempted.
The test is not hard to pass for anyone who prepared for it. Most of the questions are based on what you must have known about everyday life in the UK. But there are tons of preparatory books for the test. However, if anyone is unlucky to fail the test, the person can resit it after seven days of the test, and you are allowed to continue registering for resit until you pass.
