British Citizenship

HOW TO BECOME A BRITISH CITIZEN

There are certain rights and privileges inherent as a citizen of any country. In the united kingdom, as a citizen, the benefits are immense. If you decide to relocate to another country or stay out of the UK for many months or years, your citizenship rights cannot be withdrawn. You also enjoy Consulate protection worldwide if you notify the British Embassy in any country you chose to visit.
Unless you are a British citizen by birth, you have to follow processes before you can qualify to apply for Naturalisation. It is easier to be eligible if you are married to a British citizen. But irrespective of the route you take, you must have held Indefinite Leave to Remain for one year before you can make an application for Naturalisation.

BECOMING NATURALISED

It is always the wish of most immigrants to become Naturalised, especially when they have lived long and established in their various fields of professions in the UK. It is proper to consider the UK their home hence the need to become British citizens. After you qualify to become Naturalised, you would be invited to a ceremony to swear allegiance to the Queen. Then you would become naturalised as a British citizen.

WHO CAN APPLY FOR BRITISH CITIZENSHIP ?

Unless you acquired permanent residence rights through parents or other means, you must be 18 years or over and have a Settled status (Indefinite Leave To Remain) to be eligible to apply for British Citizenship by Naturalisation under British Nationality Act 1981.

REQUIREMENTS TO QUALIFY TO APPLY FOR NATURALISATION

The requirements are dependent on if you are married to a British citizen or not. But the default position is that an Applicant must have a settled status before making the Application. Then other criteria to be considered are:

  • Your knowledge of the English language.
  • Length of residence in the UK.
  • Evidence of good character.
  • Future intentions.

HOW TO GET UK CITIZENSHIP AS SPOUSE OF A BRITISH CITIZEN

If you are married to a British citizen, the following conditions must be satisfied for a successful Naturalisation Application under section 6(2) of the British Nationality Act 1981:

  • You must have been living in the UK for at least three years before making your Application.
  • Within that three years, you have never spent more than 270 days outside the UK.
  • You have also not spent more than 90 days outside the UK within one year of making the Application.
  • You have not breached Immigration Law at any time within at least three years of making the Application.
  • You are of good character.
  • You have good knowledge of the English language and Life In the UK Test (Though you must have satisfied this requirement during your Application for Indefinite Leave To Remain).
  • You are of sound mind and can be able to decide for yourself without help.

NOT MARRIED TO A BRITISH CITIZEN BUT APPLYING FOR NATURALISATION

If you are not married to a British citizen or if for any reason you decide not to rely on your marriage to a British citizen, the following criteria must be established by the Home Office as contained under section 6(1) of the British Nationality Act 1981:

  • You are 18 years or over on the date of your Application.
  • You are of sound mind and can decide by yourself without help.
  • You are of good character and have no recent criminal record or ever tried to commit an Immigration offence by deceiving the Home Office in the last ten years.
  • You intend to live in the UK permanently.
  • You satisfy the English language and Life In The UK test.
  • You lived in the UK 5 years from the date of your Application.
  • Within that five years, you have not spent more than 450 days outside the UK.
  • You have not stayed more than 90 days outside the UK within the last 12 months from your application date.
